ORDER:
1.In the reference read above, the Transport Commissioner, Andhra Pradesh at Hyderabad has requested for making the fitment of Global Positioning System (GPS) / General Packet Radio Service (GPRS), tracking devices / gadgets mandatory in all Transport vehicles, except the Tractors, Tractor-Trailers and light goods carriages, the gross vehicle weight of which does not exceed 3000 Kgs by prescribing a new condition in Rule 185 (1) (a) of the Andhra Pradesh Motor Vehicles Rules, 1989, to that effect. The fitment of GPS / GPRS System will ensure safety of the persons travelling in public service vehicles in general and 'women and girl' in particular and also to prevent evasion of taxes to various Government departments.
2.The Government after careful examination of the matter have decided to amend the said Rule suitably.
3.Accordingly, the following preliminary notification will be published in the Extra-Ordinary issue of the Andhra Pradesh Gazette dated: 27-06-2016.
1.The following draft amendment to the Andhra Pradesh Motor Vehicles Rules, 1989, issued in G.O.Ms.No.216 Transport, Roads and Buildings (Transport-ll) Department dated the 7th August, 1989 and published at pages 1-315 of the Rules Supplement part-I, Extraordinary issue of the Andhra Pradesh Gazette dated the 25th August, 1989 and as subsequently amended from time to time is proposed to be made in exercise of the powers conferred by section 96 of the Motor Vehicles Act, 1988 (Central Act 59 of 1988) and is hereby published in the Andhra Pradesh Gazette for the general information of the public as required by sub-section (1) of section 212 of the said Act, 1988.
2.Notice, is hereby given that the said draft amendment will be taken into consideration by the Government after expiry of a period of fifteen (15) days
from the date of publication of this notification in the Andhra Pradesh Gazette
and any objections or suggestions, which may be taken into consideration by the
Government of Andhra Pradesh.
3.The objections and suggestions shall be addressed to the Special Chief Secretary to Government, Transport, Roads & Buildings Department, Government of Andhra Pradesh, "J" Block, 5th Floor, Andhra Pradesh Secretariat at Hyderabad in duplicate.
In the said rules, after rule 185 (1) (a) (xxi), the following shall be added namely:-
"(xxii) The vehicle shall not be used without a "Tracking Device" fitted with Global Positioning System (GPS) / General Packet Radio Service (GPRS) facility, along with an inbuilt Quick Response Code reader at an appropriate place in the vehicle, which shall always stand connected to the Server maintained by an authority prescribed in this regard"
